VALENCE PROTECTIVE COATINGS RESIDENTIAL LIMITED LIFETIME WARRANTY

We warrant that our Valence Protective Coatings products will not yellow or amber due to UV rays for the lifetime of the original purchase when VPC basecoat, mender and full-flake broadcast are also used. We also warrant that our Polyurea and Urethane-based products will not chip, peel, separate, or delaminate from the vertical or horizontal, interior or exterior concrete surface for fifteen (15) years after initial installation when VPC topcoat, mender, and full-flake broadcast are also used. We warrant that all polyaspartic top coat products will be free from defects under these conditions and will perform for fifteen (15) years. Notwithstanding anything herein to the contrary, these warranties only apply to products that are properly installed on proper concrete substrate according to technical data sheets and prepared by certified Valence Protective Coatings installers and with all non-expired Valence Protective Coatings products with a completed and approved warranty form.

Replacement is limited to the original cost of materials and replacement, at the sole option of Valence Protective Coatings. Such original cost of materials or replacement of failed areas, at Valence Protective Coatings, Inc.’s sole option, shall be the only responsibility Valence Protective Coatings, Inc. under this warranty. Valence Protective Coatings, Inc. reserves the right at all times to inspect the claimed defective material and verify warranty coverage on the jobsite or at its factory laboratory. The customer shall be responsible for the remainder of any costs of installation or product price increase over and above the original purchase price.

In order for such warranty to be applicable, a representative of Valence Protective Coatings must be present to assess the failed areas and judge the cause and mode of failure prior to any reimbursement of original cost of materials or replacement of failed areas. This warranty does not extend to cover defects resulting from or related to the installation process, including but not limited to, installation in an environment, location, or circumstances in which the product or materials were not intended or appropriate. This warranty also does not extend to cover products or materials installed in violation of any applicable local code or ordinance or any other law or regulation.

This warranty does not extend to cover cracks or cracking, abuse, alterations, damage due to animal chewing or clawing, cutting, chipping, accident, fire, extreme heat damage (over 250 degrees F), damage to solvents, smoke damage and the like, or blistering, lifting, bubbling, or delamination, due to moisture or any contamination of the concrete substrate. Failure to properly prepare the substrate surface as per Valence Protective Coatings instructions or advisories, or if products are installed or applied on top of, or mixed with other products not approved within the supplied instructions such as mixing our (Valence Protective Coatings) products with unapproved solvents or thinners, or applying Valence Protective Coatings Inc. products over existing inferior paints or coatings, or otherwise using the products for other than their approved and intended use.

Proper concrete surface preparation by mechanical grinding includes removing all previous coatings, sealers, laitance, efflorescence, water repellents, curing compounds, oils, grease, waxes, and any other impediments to adhesion. The required surface profile must have a minimum 30 to 70 grit, a neutral pH of 7 and a moisture vapor transmission not to exceed 8 pounds. Valence Protective Coatings is not responsible for determining if moisture transmission exists within the concrete substrate. Valence Protective Coatings warranty liability will not exceed the cost of replacement materials.

Any surface can be slippery, especially when wet with any fluid. In no event shall Valence Protective Coatings be responsible for injury incurred by a slip or fall situation. It is the purchaser’s responsibility to provide for their own safety and the safety of their guests. While slip resistant additives assist slip/fall prevention, there is no guarantee that someone will not slip while walking on coated areas. Valence Protective Coatings is not responsible for any slip and/or fall incidents due to a wet floor. No one (besides a Valence Protective Coatings representative) is authorized to make any other warranties on our behalf. VPC Warranty Registration Card must be filled out and mailed in for warranty submission no later than seven (7) days after completion of the job for approval and signature from a VPC Warranty representative. Each coated location will need a separate warranty card. Note: Failure to follow these instructions will void the warranty. Please see all Technical Data Sheets and instructions associated with products to be used before installation.

 

ANY IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, SHALL NOT EXTEND BEYOND THE APPLICABLE WARRANTY PERIOD SPECIFIED ABOVE VALENCE PROTECTIVE COATINGS SOLE LIABILITY WITH RESPECT TO ANY DEFECT SHALL BE AS SET FORTH IN THIS WARRANTY AND ANY CLAIMS FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES (INCLUDING DAMAGE FROM WATER LEAKAGE) ARE EXCLUDED.
